2 Booking and Playing

2.1 Booking

In normal circumstances your bookings is confirmed with the club automatically when you make the booking. You will always be given an exact tee-time at the time of booking. In some cases this time may change slightly when the booking is confirmed with the club. If this difference is greater than 30 minutes then we will send you an email or telephone you on the contact number you have provided.

Some of our member clubs do not operate tee-times. In this case you will have booked a specific time but may have to wait a few minutes when you arrive and join the club's queuing system. In this case we will send you an email with this information.

You should always ensure you arrive at the club with plenty of time to spare.

Is there a booking fee?

TeeGenius does not charge a booking fee for bookings made through Our website. Bookings made through the call centre will incur a �1 charge per golfer to cover administration costs. We will not charge for any booking made through the call centre unless it is available free of this charge on Our website.

I have not received a confirmation of my booking yet

All bookings are confirmed by email. It may be that you have entered an incorrect email address or there is some delay in reaching you. Please wait for a while to allow it to come through. You can contact our customer services team on 0870 300 55 00 to enquire about a confirmation.

2.2 Small Party Sizes

2.2.1 Can extra people turn up on the day, if I make a booking for less than 4?

Yes but the Club may not accept the extra players. It is at the Club's discretion whether to accept extra players and they may from time to time add other people to Your booking if You have booked for fewer than the maximum. We strongly suggest that You book for the correct number of players in Your group. If You are able to add extra players on the day You must pay for them at the Club.

2.3 Course Etiquette

2.3.1 Where do I find Etiquette Information?

Our Clubs have different etiquette requirements. You are able to view these on Our site before making Your booking, and You will receive notification of them in Your booking confirmation.

2.3.2 What do I do with Etiquette Information?

Please ensure that Your adhere to these requirements during Your visit to the Club or You may be refused play. Neither TeeGenius nor the Club can be held responsible if play is refused because of a failure to observe the Club's etiquette requirements.

3 Payment

3.1 Making payment

3.1.1 When do I pay?

Your payment details will be taken at the time of booking in order to secure Your Tee-Time and this payment will be authorised by TeeGenius. The funds will not be taken from your account at this time.

TeeGenius offer a flexible payment option to aid operations at some clubs on the network. You will be informed at the time of booking whether you are to pay at the club or whether TeeGenius will take the money on the club's behalf.

i)Payment taken at the club. Your payment details have been authorised but We will not take payment for the booking. In the event of you failing to cancel your booking and failing to arrive at the course we will take the full amount of the booking on behalf of the club as compensation for the lost revenue.

ii)Payment taken by TeeGenius. In this case We will have authorised your payment details and will take payment from you, usually two hours before your booked tee-time.

WE RECOMMEND THAT YOU ALWAYS PRINT OFF YOUR CONFIRMATION SO YOU CAN CHECK WHETHER YOU HAVE TO PAY AT THE CLUB.

3.1.3 How can I pay?

TeeGenius takes Your payment details at the time of booking and accepts various credit and debit cards via Our website and call centre. Unfortunately We are not able to accept cash or cheques.

3.2 Vouchers and Promotional Codes

3.2.1 What is a Voucher or a Promotional Code?

From time to time, TeeGenius will issue Vouchers and Promotional Codes. These vouchers will have a monetary value assigned to them and can be used as part payment for bookings. Generally a Voucher or Promotional Code will have an expiry date and You will not be able to use it after that date.

3.2.2 How do I redeem a Voucher or a Promotional Code?

Simply enter the Voucher number or Promotional Code when making a booking. When redeeming the Voucher in a transaction that is greater than the value of the Voucher, You must provide additional payment to make-up the shortfall. When redeeming a Voucher in a transaction that is less than the value of the Voucher no change will be provided and the excess value will be lost.

3.3 No-Show

3.3.1 What happens if I don't turn up?

If You do not turn up to play without having previously cancelled Your booking then you will be considered a no-show. At this point we reserve the right to take full payment and you are not entitled to a refund.

3.3.2 What happens if someone else in my group doesn't turn up?

If someone in Your group does not turn up to play without having previously cancelled them from the booking, either by cancelling and re-booking or by contacting the call centre to remove the individual, then no refund will be given to You. Additionally, a Club may fill extra places in Your party at their discretion.

4 Cancellation and Changes

4.1 If I Cancel my booking

4.1.1 What if I need to cancel a booking?

TeeGenius operate a club-dependent system of cancellations. We will follow the system in place at the club and adhere to their cancellation policy. You will be advised of this policy at the time of booking and in Your confirmation email.

If there is no cancellation policy at the club then Your booking will be subject to the TeeGenius standard cancellation terms.

4.1.2 Is there an administration charge for cancelling my booking?

No. TeeGenius does not charge an administration charge for cancellations.

4.2 If the Club cancels or changes my booking

4.2.1 If the club cancels my booking

If the club cancels Your booking then We will do our best to contact You via email or using the contact number you have provided to discuss alternatives.

4.2.2 If the Club changes my booking

From time to time a club may need to change a tee-time when it is confirmed or at any time before the round is played. If this difference is greater than 30 minutes then we will send you an email or telephone you on the contact number you have provided. If we are unable to get in contact with you then we reserve the right to cancel the booking.

4.2.3 Do I get a refund if the club cancels or changes my booking?

If You do not wish to take one of the alternatives on offer then Your credit/debit card will not be charged.

4.2.4 What if there is a difference in price after the change of my booking?

If You decide to take an alternative Tee-Time then it is possible that there will be a difference in price between the total value of Your original booking and the total value of Your new booking. Should the new value be less than the original then TeeGenius will refund the difference to You. Should the new value be more than the original value then You will have to pay the difference.

4.2.5 What happens if You can't contact me?

If We are unable to contact You to inform you of a change or cancellation of more than 30 minutes or that we deem necessary to inform you of We reserve the right to cancel Your booking and automatically give You a full refund.

As We automatically cancel Your bookings, it is very important to give Us a valid telephone number when making the booking so that We can get in touch if there are problems.

5 Issues On The Day

5.1 What if something goes wrong on the day?

If You are dissatisfied with the facilities provided at the golf course You must inform the course staff before leaving. They will endeavour to do their best to resolve Your problem. If they are unable to resolve the problem then You should contact TeeGenius and we will do our best to find a resolution.

5.2 What if the Club doesn't have a record of my booking?

In the unlikely event that a golf course does not recognise Your booking reference they might ask for payment before issuing You with a ticket to play. In this case you should contact Us immediately.

5.3 Course Maintenance

From time to time a golf course will undergo planned maintenance such as 'Tining' or will use winter greens or winter tees. The Club will notify TeeGenius in advance of this and TeeGenius will display relevant information on the booking screens so that You are aware before You make Your booking.

From time to time a golf course will need to undergo unplanned maintenance. TeeGenius cannot be held responsible for problems occurring at the course as a result of maintenance of which We are not aware.

5.4 Course Closures

From time to time a golf course will be forced to close for example as a result of very bad weather. In these cases We or the club will endeavour to inform You before-hand. You will be given a complete refund. If the course closes during your round then place contact us at your earliest opportunity.

It is important that you provide us with a valid contact number so we can get in touch with you if a situation like this arises.

6 Our Website

6.1 Your conduct

You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way.

You understand that You, and not TeeGenius, are responsible for all electronic communications and content sent from Your computer to Us and You must use the website for lawful purposes only.

You must not use the website for any of the following:

for fraudulent purposes, or in connection with a criminal offence or other unlawful activity to send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam" to cause annoyance, inconvenience or needless anxiety.

In order to access the website, You will need to follow a registration process and You will be supplied with a User ID and password. You will provide TeeGenius with certain details, all of which must be both accurate, complete and up to date. It is Your responsibility to update TeeGenius immediately with any changes to the information provided.

TeeGenius reserve the right not to accept or process Your application for registration for any reason.

Your registration is personal to You and You are responsible for maintaining the confidentiality of Your password and User ID. Access to this Website will be denied should this condition be breached or if You attempt to bypass the subscriber security to gain unauthorised access to data on the TeeGenius website. Legal action will be taken against any person who attempts to violate the security of this Website. Any unauthorised use of the website and/or of Your password and User ID should be notified to TeeGenius immediately.

6.2 Copyright and database rights

All content included on the website, such as text, graphics, logos, button icons, images and software, is the property of TeeGenius, its affiliates or its content suppliers and is protected by United Kingdom and international copyright and database right laws. The compilation of all content on this website is the exclusive property of TeeGenius and its affiliates and is protected by United Kingdom and international copyright and database right laws. All software used on this website is the property of TeeGenius, Our affiliates or Our software suppliers and is protected by United Kingdom and international copyright laws.

You may not systematically extract and/or re-utilise parts of the contents of the website without TeeGenius' express written consent. In particular, You may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this website, without TeeGenius' express written consent. All other trademarks not owned by TeeGenius that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by TeeGenius.

6.4 Access to TeeGenius.co.uk

We will do Our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, Your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

TeeGenius grants You a limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of TeeGenius. When You visit TeeGenius.co.uk or send e-mails to Us, You are communicating with Us electronically. We communicate with You by e-mail or by posting notices on the website. 7.2 Our Responsibility

TeeGenius is operating as a booking agent for the golf clubs and is not responsible for the provision of the final product, in this case Your round or rounds of golf at a selected golf Club. Your contract is between the yourself and the golf club. It is Your responsibility to engage with the Club before commencing play.

7.3 Alterations To Terms And Conditions

We reserve the right to make changes to Our website, policies, and these Terms and Conditions at any time. You will be subject to the policies and Terms and Conditions in force at the time that You use the website or that You make a booking through Us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to bookings previously placed by You). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining conditions.

7.4 Disclaimers

The information contained with the Website is provided on an as is basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Website.

We do not guarantee uninterrupted availability of the TeeGenius website and cannot provide any representation that using the Website will be error free.

7.5 Liability

TeeGenius Ltd, and any of its directors, employees, officers, shareholders, parties involved in the delivery of the TeeGenius service and agents acting on any of their behalf exclude all liability and responsibility for any loss of income, profits, goodwill, data, contracts, and business interruption (whether direct or indirect), and for all indirect, punitive, special or consequential losses or damages, whether arising in tort (including without limitation negligence), contract or otherwise, in connection with this Website, the content and/or TeeGenius services whether provided through the Website or otherwise in any way or in connection with the use, inability to use or the results of use of this Website, any websites linked to this Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect Your computer equipment, software, data or other property on account of Your access to, use of or browsing this Website or any websites linked to this Website.

Nothing in these Terms and Conditions shall exclude or limit TeeGenius' liability for (a) death or personal injury caused by negligence (as such term is defined in the Unfair Contract Terms Act 1977); (b) fraud; (c) misrepresentation as to a fundamental matter; or (d) any liability which cannot be excluded or limited under applicable law.

TeeGenius does not accept liability for any servicing, repair or correction of equipment, software or data as a result of using Our web services.

In any event where TeeGenius Ltd is found to be liable to You under these Terms and Conditions, this liability shall not exceed the monetary amount received from You by TeeGenius for the booking or bookings in question.

7.6 Governing Law and Jurisdiction

These Terms and Conditions will be governed by the laws of Scotland and the parties hereby agree to be bound exclusively by the jurisdiction of Scottish courts without reference to rules governing choice of laws.

9 Monthly Newsletter Prize Draw Competition

1. The monthly prize draw is open to all UK residents except employees of TeeGenius Ltd, their agents and families.
2. The promoter reserves the right to amend, alter or foreclose the promotion without prior notice.
3. Only one entry per email address.
4. The monthly prize draw closing date is the 30th of every month.
5. The winner will be chosen at random and notified by email or telephone by the 10th of the following month.
5b. Tweleve runners-up will be chosen at random and notified by email or telephone by the 10th of the following month.
6. TeeGenius reserves the right to select another winner if it is unable to contact the first winner after what it considers to be a reasonable number of attempts.
6b. TeeGenius reserves the right to select another runner-up if it is unable to contact a runner-up after what it considers to be a reasonable number of attempts.
7. Entrants agree to allow permission for their names to be used for promotional activities.
8. TeeGenius reserves the right to supply an alternative prize of similar value if necessary.
9. The first prize is a pair of VIP tickets to the South East Golf Show and accommodation at the East Sussex National Golf and Spa Resort for the evening of the 9th of November, 2007.
10. There are tweleve runner-up prizes of a single VIP ticket to the 2007 South East Golf Show.
11. Full details of the prize will be provided to the winner and runners-up once the draw has taken place.
12. Competition entrants must be 18 years or old.

14. These rules are governed by Scottish Law and are subject to the exclusive jurisdiction of the Scottish Courts.
